BİLGİ, FİKRİ MÜLKİYET VE KURUMSAL DEĞİŞİM: DÖRDÜNCÜ SANAYİ DEVRİMİ’Nİ KURUMSAL BİR ÇERÇEVEYE OTURTMAK

Öz:
Sanayi 4.0 günümüzde yapay zeka, makine öğrenmesi, nesnelerin interneti, akıllı fabrikalar gibi teknolojileri ve beraberinde getirdiği kurumsal değişimi tanımlamak için başvurulan bir kavramdır. Sadece yeni teknolojilerin rolüne odaklanmak teknolojik değişimin toplumsal boyutunu göz ardı etmemize neden olabilmektedir. Burada kastedilen, yeni teknolojilerin nasıl bir kurumsal çerçevede seçildiğinin ve geliştirildiğinin anlaşılmasıdır. Bu bağlamda, yazıda teknolojik değişim ile fikri mülkiyet hakları arasındaki ilişki ele alınmaktadır. Sanayi 4.0 tartışmalarına ilişkin teknolojik değişimler iki alandaki fikri mülkiyet hakları genişlemesiyle sıkı sıkıya ilişkilidir. İlki 1980’lerden sonra hızlanan ve bilimsel bilgiyi içeren düzenlemeleri kapsarken, tarihsel olarak daha gerilere dayanan ikinci gelişme işyerindeki bilginin yasal statüsüyle ilgilidir. Bu iki alandaki yararlı bilgi son iki yüzyılda firmanın malı haline gelmiştir.

Knowledge, Intellectual Property, and Institutional Change: An Institutional Framework for the Fourth Industrial Revolution

Öz:
Industry 4.0 has become a frequently used concept to describe technologies such as artificial intelligence, machine learning, internet of things, smart factories, and the institutional change it brings. Focusing only on the role of new technologies may lead us to ignore the social dimension of technological change. What is meant here is to understand how new technologies are selected and developed in an institutional framework. In this context, the article discusses the relationship between technological change and intellectual property rights. New technologies associated with Industry 4.0 debate are closely related to the expansion of intellectual property rights in two areas. While the first covers the regulations that accelerated after the 1980s and include scientific knowledge, the second historical development is related to the legal status of knowledge in the workplace. In these areas, useful knowledge have become the property of the firm in the last two centuries.
