OECD/DÜNYA BANKASI MODEL REKABET KANUNU
Öz: el teşebbüslerin rekabete aykırı eylem ve işlemlerinin uluslararası düzeyde ele alınmasına yönelik pek çok ikili ve çok taraflı girişim başlatılmış ise de, bu girişimlerin olumlu sonuçlar vermesi, ülkelerin rekabet hukuku ve politikası açısından ortak bir anlayışa sahip olmalarını gerektirir. Uluslararası alanda böylesi bir ortak anlayışın sağlanmasına yönelik çalışmalardan bir tanesi de Model Kanun çalışmalarıdır. Bu çerçevede, OECD ve Dünya Bankası tarafından 1999 yılında yayımlanan Model Kanun, rekabet düzenlemesine sahip olmayan gelişme yolundaki ülkelerin örnek alabilecekleri bir metin oluşturarak, rekabet hukuku ve politikası konusunda ortak anlayışın geliştirilmesini amaçlamaktadır. Model Kanun gelişmekte olan ülkelerin tüm hassasiyetlerini yansıtmamakla birlikte, esnek yapısı sayesinde bu ülkeler tarafından kullanılabilecek niteliktedir.

Öz: Although several bilateral and multilateral initiatives have been launched at the international level for addressing anti-competitive practices of private enterprises, for yielding positive results, a common understanding is required among the countries, in terms of competition law and policy. One of the efforts at the international arena for reaching such a common understanding is the Model Law studies. In this context, Model Law of the OECD and the World Bank, published in 1999, aims to create a common understanding, by establishing a model text for the benefit of developing countries, which have no competition laws. Although some aspects of the Model Law do not reflect the sensitivities of developing countries, through its flexible structure, it can be used by those countries.
