TY - JOUR TI - FOR INVESTOR-STATE DISPUTES, WHICH DISPUTE RESOLUTION MECHANISMS SHOULD BE CHOSEN IN BILATERAL INVESTMENT TREATIES–FROM THE PERSPECTIVE OF TURKEY? AB - Bilateral Investments treaties are aimed at promotion of investmentsand protection of rights of both states and investors. When there isan investment dispute, the main issue particularly for investors would bewhich dispute resolution mechanism set out in the BITs could be chosen.The options are negotiation, mediation and arbitration. If arbitration ischosen the main issue would be which of the arbitration options availablein the BITs should be chosen. There are a number of main issues totake into account for choosing the arbitral forum: differences between adhoc and institutional arbitration, scope of applicable law, enforceability,and time and costs. In this note, the above issues shall be examined fromthe perspective of bilateral investment treaties Turkey is a party. For thispurpose, a number of bilateral investment treaties are chosen as examples.
