COVID-19 OUTBREAK AND STATE AIDS IN TRANSPORTATION: EUROPEAN COMMISSION’S APPROACH

Öz:

This article argues the most recent EU competition law developments in terms of state aid schemes in the transportation sector in the context of COVID-19. Accordingly, all approvals given in the last two years to state aids are surveyed throughout the paper to reveal the EC’s approach. It is discussed whether travel restrictions due to the wide spread of coronavirus necessitate compensation for transportation operators, as one of the most affected groups. In sum, compensating this vital industry through state resources is debated at a national level in terms of every member state of the European Union (EU) through analysing the European Commission (EC)’s approach to these compensation schemes.

Öz:

Bu çalışma, ulaştırma sektörüne yönelik olarak COVID-19 kapsamında sağlanan devlet yardımları özelinde Avrupa Birliği rekabet hukukuna ilişkin güncel gelişmeleri tartışmaktadır. Bu doğrultuda, son iki sene içerisinde onaylanan tüm devlet desteği tasarıları incelenerek Avrupa Komisyonu’nun bu yardımlar karşısındaki olumlu tutumu ortaya konulmuştur. Bununla birlikte, erişilebilir olması önem arz eden ve kamusal niteliği haiz olan yolcu taşımacılığı hizmetlerini yürüten işletmelerin uygulanan seyahat yasakları nedeniyle uğradıkları zararlarının tazmin edilmesinin bir gereklilik olup olmadığı hususu ele alınmıştır. Özetle, her bir Avrupa Birliği üye ülkesinin koronavirüs kapsamında sağladığı devlet destekleri de göz önünde tutularak ulaştırma sektörünün devlet yardımları ile desteklenmesi hususu detaylıca incelenerek Avrupa Komisyonu’nun yaklaşımı üzerinde durulmuştur.
