Öz:

Yetki Anlasmasına Dair Lahey Sözlesmesi, Lahey Devletler Özel Hukuku Konferansının yirminci oturumunda kabul edilmis bir milletlerarası usul hukuku sözlesmesidir. Sözlesme esas itibariyle münhasır yetki anlasmalarını ve yetkili kılınan mahkemenin verdiği kararların etkisini düzenlemektedir. Âkit devletler üç konuda yükümlülük altına girmektedirler: 1. Sözlesmeye uygun olarak hazırlanmıs bir münhasır yetki anlasması ile yetkili kılınan devlet mahkemesi davayı görmelidir, 2. Münhasır yetki anlasması ile yetkili kılınan mahkeme dısında baska bir âkit devlet mahkemesi davaya bakamaz, 3. Münhasır yetkili kılınan devlet mahkemesinin verdiği kararlar diğer âkit devletlerde tanınır ve tenfi z edilir. Sözlesme, yetki anlasmalarının, en azından, âkit devletler arasında etkinliğini sağlamayı amaçlamaktadır.

Convention on Choice of Court Agreements is a convention of international procedure law

Öz:

Convention on Choice of Court Agreements is a convention of international procedure law that was drawn up at the Twentieth Session of the Hague Conference on Private International Law. The Convention is mainly about exclusive choice of court agreements and effects of judgments resulting from proceedings based on such agreements. A Contracting State has three obligation with this Convention: 1. The chosen court that designated in exclusive choice of court agreements must hear the case, 2. A court of a Contracting State other than that of the chosen court can not hear the case,3. A judgment given by a court of a Contracting State designated in a exclusive choice of court agreements shall be recognised and enforced in other Contracting States. The Convention has aimed to maintain effectiveness of choice of court agreements among Contracting States.
