Savaş hukukunda tecavüz ve yağmayı yasakla(ma)yan rejimler lahey sözleşmeleri (1899, 1907)

Öz:
Bu makale savaşlarda görülen benzer iki uygulama olan yağma ve tecavüzün uluslararası hukukça ele alınışına bakarak birbiriyle ilişkili iki teorik soruya cevap aramaktadır: Uluslararası ilişkilerde değişim, bilhassa hukuksallaşmış rejim değişimi nasıl gerçekleşir ve toplumsal cinsiyetin bir kategori olarak bu değişim sürecindeki rolü nedir? Buradaki görüş, hukuksallaşmış bir yasak rejiminin ortaya çıkabilmesi için üç şartın gerekli olduğudur: Öncelikle devletler yasağa uyabileceklerine inanmalıdır çünkü ihlâlin maliyeti yüksektir. İkincisi söz konusu uygulamanın anormal/istenmeyen olduğuna dair fikirlerin gelişmesine elverişli bir normatif ortam gereklidir. Son olarak, bu fikirleri yayarak rejim oluşumu için çalışan aktörler olmalıdır. Yağma ve tecavüze karşı rejimlerin oluşumu arasındaki 100 yıllık zaman farkı toplumsal cinsiyetin bu süreçteki rolünü de açığa çıkarır.

The (non-)prohibition of rape and pillage in war: the hague conventions (1899, 1907)

Öz:
Th is article seeks to explain two related theoretical questions by looking at the treatment of two related practices of war, pillage and rape, by international law: How does change, particularly legalized regime change, happen in international relations and what is the role of “gender” as a category in this process of change? Th e argument here is that three conditions are necessary for the emergence of a legalized prohibition regime: Firstly, states must believe that they can comply with the prohibition because non-compliance is costly. Secondly, a normative context conducive to the idea that the particular practice is abnormal/undesirable is necessary. Th irdly, actors actively propagating these ideas to promote the creation of a particular regime should exist. Th e 100-year temporal diff erence between the emergence of the regimes against pillage and rape reveals the role of gender in this process.
