Hukuk Analitiği

Öz:
Hukuk analitiği, son yıllarda hızla gelişmekte olan bir hesaplamalı hukuk alanıdır. Temelini 1980’lerdeki bilirkişi sistemlerinden alarak, hukuk analitiği zamanla daha çok matematik ile iç içe geçmiş; başta istatistik olmak üzere, hukuk analitiği matematiğin birçok alanından etkilenmiş ve son olarak makina öğrenmesi tekniği ile, çoğu problemin üstesinden gelmiştir. Şimdilerde, hukuk analitiği yapay zekâ disiplinindeki çeşitli araçları kullanır hale gelmiştir. Hukuk analitiğinin hukuki veriyi kullanılabilir kılması ile birlikte, bu alan empirik hukuk çalışmalarının ve hukukta sosyal ağ analizi konularının gündemine girmiştir. Bu araştırmada, hukuk felsefesine dair çeşitli konulardan bahsedilmiş ve hukuk teorisi ile empirik hukuk alanı karşılaştırılmış ve değerlendirilmiştir. Ayrıca, makina öğrenmesi ve matematiğin hukuk analitiğine olan etkileri incelenmiş ve hukukun hukuk analitiği dolayısı ile matematiğin konusu olabileceği sonucuna varılmıştır. Bunun yanında sosyal ağ analizi araçlarının hukukun kompleks sistemler ile benzerlik gösterebilecek özelliklerini ortaya çıkarma potansiyeli olduğu sonucuna da ulaşılmıştır.

Legal Analytics

Öz:
Legal analytics is a burgeoning field of computational law that has shown quite an advance in recent years. Taking its foundations from expert systems at 1980’s, legal analytics have become more intertwined with mathematics. Starting from statistics, legal analytics have been effected by various fields of mathematics and lastly with the machine learning technique, it has overcome many of its problems. Nowadays, legal analytics uses various tools that are currently developing from artificial intelligence discipline. As legal analytics made legal data avalaible, the field has come to the fore for empirical legal studies and application of social network analysis on law. In this research, various topics from legal philosophy have been mentioned and legal theory and empirical legal field have been contrasted and evaluated. Also, effects of machine learning and mathematics are also been evaluated and as a result, it has been concluded that law could be a domain of legal analytics and thus, mathematics. It has been also concluded that social network analysis tools have the potential to uncover various aspects of law that shows similiarity with complex systems.
