Otonom silah sistemleri ve insancıl hukuk
Öz: Günümüz silahlı çatışmalarında hızlı karar alan ve bu kararını en iyi şekilde uygulayan ordular zafer kazanmaktalar. Bu ise savaş alanında yorulmak bilmeyen, aynı anda birden fazla veriyi algılayıp değerlendirebilen otonom silah sistemlerinin kullanımın artmasına neden olmuştur. Hâlihazırda bazı ülkeler tarafından kullanılan otonom silah sistemlerinden yararlanılmasında artış beklenmektedir. Bu artış elbette etik, siyasi ve hukuki açıdan bu meselenin incelenmesini zorunlu kılmaktadır. Bu makalede bu silah sistemlerinin insancıl hukuk açısından değerlendirilmesi hedeflenmektedir. Bu incelemede ikili bir ayrımda bulunmak gereklidir. İlk olarak silah veya savaş araç ve gereçlerinin doğasına ilişkin insancıl hukuk kuralları ele alınmalıdır. Bundan sonra silahlarının kullanımına ilişkin kurallara kısaca değinilecektir.

Autonomous weapon systems and humanitarıian law
Öz: Pundits of international armed conflict and international law have been highlighting an important development in warfare that has been marking the conflict zones recently, i.e. the development and widespread usage of the so-called “autonomous weapon systems”. These systems are already being used by the armies of some countries like USA and Israel. There are reports that this tendency will continue and reshape the war machines of the future immensely. In this paper, I will try to probe into these systems and their status in international humanitarian law. In this endeavor, I shall have a two-fold approach; first the nature of these weapons in terms of humanitarian law will be investigated. Then, we will briefly highlight those humanitarian rules pertaining to the usage of weapons.
