I ŞİD'E KARŞI SURİYE'DE YAPILAN OPERASYONLARIN MEŞRUİYETİ BAKIMINDAN 'İSTEKSİZ YA DA ACİZ DEVLET' TEORİSİ

I ŞİD'E KARŞI SURİYE'DE YAPILAN OPERASYONLARIN MEŞRUİYETİ BAKIMINDAN 'İSTEKSİZ YA DA ACİZ DEVLET' TEORİSİ
Öz: Bu çalışmada, IŞİD terör örgütü ile mücadele için ABD önderliğinde kuru- lan uluslararası koalisyonun, Suriye'de gerçekleştirdiği operasyonların meşruiyetindekilit bir önem taşıyan 'isteksiz ya da aciz devlet' teorisinin uluslararası hukuktaki değerive Suriye bakımından uygulanırlığı tartışılacaktır. Uluslararası hukukta kuvvet kullan- ma yasağına ilişkin hukuki çerçeveye kısaca değinildikten sonra, IŞİD'e karşı operasyo- na katılan devletlerin, operasyonlar konusundaki hukuki gerekçeleri incelenecek ve bubağlamda özellikle devlet dışı aktörlere karşı meşru müdafaa sorunu ile 'isteksiz ya daaciz devlet' teorisine dair tartışmalara yoğunlaşılacaktır.

The 'Unwilling or Unable State' Theory with Respect to the Lawfulness of the Operations Against Isis in Syria
Öz: Within this study, owing to its key importance in the lawfulness ofthe operations of US-led international coalition to fight against ISIS in Syria; the valueof the 'unwilling or unable state' theory in international law and its applicability in Syriawill be discussed. Following a brief touch on the legal framework for the prohibition of the use offorce in international law, the legal justification of the states participating in theoperations against ISIS will be gone through and within this context; particularly, thedebate around the issue of self-defence against non-state actors and the theory of'unwilling or unable state' will be centered upon
