1978 Devletlerin Uluslararası Andlaşmalara Halefiyeti Sözleşmesi Işığında İkili Andlaşmalara Halefiyet: Teorik Bir Değerlendirme

Öz:
Halefiyet hukuku, belli bir ülke üzerindeki egemenlik yetkisinin bir devletten bir başka devlete intikali sonrasında, ülke üzerinde kurulmuş olan hukukî ilişkilerin akıbetinin ne olacağı sorusuna cevap vermeye çalışan kurallar bütünüdür. Bu çerçevede, selef devletin taraf olduğu uluslararası andlaşmaların halef devlete intikal edip etmeyeceği meselesi modern uluslararası hukukun en tartışmalı meselelerinden biri olarak karşımıza çıkmaktadır. Mesele üzerindeki en kapsamlı çalışma Uluslararası Hukuk Komisyonu'nun öncülüğünde 1978 yılında akdedilen Devletlerin Uluslararası Andlaşmalara Halefiyeti Sözleşmesidir. Sözleşme, bütün uluslararası andlaşmalar için yeknesak kurallar öngörmemekte, çok taraflı uluslararası andlaşmalara halefiyet ve ikili uluslararası andlaşmalara halefiyet alanlarında farklı düzenlemeler ihtiva etmektedir. Sözleşme'nin çok taraflı uluslararası andlaşmalar için öngördüğü düzenlemelerin bugüne kadar pek çok akademik çalışmanın konusunu teşkil ettiği, ikili andlaşmalara halefiyet meselesinin ise uluslararası hukukçular tarafından yeterince incelenmediği görülmektedir. Buradan hareketle, elinizdeki çalışma 1978 Sözleşmesi'nin devletlerin ikili andlaşmalara halefiyeti alanında öngördüğü düzenlemeleri incelemektedir

State Succession To Bilateral Agreements in Light of the 1978 Convention on Succession of States in Respect of Treaties: A Theoretical Assessment

Öz:
The law of State Succession deals with the replacement of one State by another in the responsibility for the international relations of a territory. In this context, the issue of State Succession to treaties is one of the most controversial ones in modern international law. The 1978 Vienna Convention on Succession of States in Respect of Treaties, prepared by the International Law Commission, is the most comprehensive work on the subject. The Convention does not provide a unique framework for State Succession to all treaties, but foresees different rules for multilateral and bilateral treaties. While the provisions of the Convention concerning succession to multilateral treaties have been subject of numerous studies, internationalists have not paid sufficient attention to succession to bilateral treaties. In this context, this paper strives to analyze the principles provided under the 1978 Convention for State Succession on bilateral treaties.
