Bilgi Toplumunun Delil Türü: Sayısal Deliller ve Bilimselliği

Öz:
Sayısal delil, bilişim sisteminde saklanan, depolanan ve işlenen veriyi temel almaktadır. Verinin delil olarak kabul edilmesi için en önemli nokta, bilimsel yöntemlerle elde edilmesidir. 1923 yılında Amerikan Yüksek Mahkemesi, Frye v. United States kararında, delilin bilimsel olarak kabul edilebilirliği için "genel kabul" ölçütünü getirmiştir. Yüksek Mahkeme, 1993 yılında Daubert kararında, bilirkişi tanıklığının kabul edilmesi için mahkeme tarafından değerlendirilmesi gereken bağlayıcı olmayan dört ölçüte işaret etmiştir. Bunları şöyle sıralayabiliriz; (1) delilin, ilgili bilim topluluğu tarafından genel kabul görüp görmediği, (2) metodolojinin yayınlanıp, bilimsel incelemeye tabi tutulup tutulmadığı, (3) metodolojinin bilinen veya olası hata oranlarının bulunup bulunmadığı, (4) sonuçların test edilip edilmediği. Çalışmamızda, söz konusu ölçütler kapsamında sayısal delil incelenecektir

The Evidence Type of Information Society: Digital Evidence and Its Scientific Character

Öz:
Digital evidence is based on data saved, stored and processed in information systems. The most important point that the data can be accepted as an evidence is to derive it from information systems with scientific methods. In 1923, the "general acceptance" standard for the admissibility of scientific evidence was set in Frye v. United States. In 1993, in Daubert v. Merrell Dow Pharmaceuticals, The Court further enumerated four nonbinding factors courts could consider in evaluating the admissibility of expert testimony: (1) whether such evidence was generally accepted by the relevant scientific community; (2) whether the methodology was published and subject to peer review; (3) whether the methodology has a known or potential rate of error; and (4) whether the results are testable. In our study, digital evidence will be examined in the light of those mentioned factors
