TY - JOUR TI - THE PRINCIPAL OF ADVERSARIAL PROCEDURE IN CRIMINAL PROCEEDINGS IN THE LIGHT OF EUROPEAN COURT OF HUMAN RIGHTS CASE-LAW AB - Modern criminal procedure adopts the realization of an adversarial procedure between the equally armed parties as the most effective method in finding the material fact. Therefore, the predominant method in modern criminal procedure is the adversarial procedure method. The appropriate way to realize the adversarial procedure can be possible as a result of evenly armament of claimant and defendant. In this study, the principal of adversarial procedure, predominant in modern criminal trial, will be examined in details in light of the arrangements of European Convention on Human Rights (ECHR) and European Court of Human Rights (ECtHR) decisions. The basic method to be employed when discussing the subject is to get use of differing opinions on doctrine and ECtHR case-law.
