TI  - CRIME OF FINANCING OF TERRORISM UNDER TURKISH CRIMINAL LAW
AB  - In order to combat terrorism and terroristorganizations in an efficient way, cutting offthe resources funding terrorism is importantas much as criminalization of such acts.Turkey signed International Convention forthe Suppression of the Financing of Terrorismadopted in 1999 by United Nations andregulated financing of terrorism, as such, asa type of crime distinct from assistance toterrorist organization, through amendmentof Anti-Terror Law in 2006 for the first timewith the aim of combatting terrorism and itsfinancing in an efficient way. Law regardingSuppression of the Financing of Terrorismdated 2013 and numbered 6415, as a specialcode, regulated financing of terrorism asan independent crime as well as regulatingadministrative measures to seize theproceeds derived from financing of terrorism.Crime of financing of terrorism assures legalvalues such as indivisible integrity of the statewith its territory and nation, constitutionaland democratic order, public peace andtranquility, fundamental rights and liberties.The acts criminalized with the relevant typeof crime are providing to or gathering forterrorist organization, money or any kind ofmovable or immovable properties, rightsor receivables, which can be representedby money, with the knowledge of theorganization’s purpose and characteristicsbut without being a member of terroristorganization. In this article, legal element,material element, moral element, illegalityelement, factors affecting crime, specialforms of crime appearance, provisions ofpunishment and procedure will be analyzed.
