Şirketlerin İnsan Haklarına İlişkin Yükümlülüklerinin Niteliği ve Temellendirilmesi Sorunu: Saygı Gösterme Sorumluluğu Ne Yükler?
Öz: Egemen devletler Westphalia modeline dayalı klasik uluslararası hukukun temel öznesi olmuşlardır. Ancak bireyikeyfi devlet müdahalelerine karşı korumak üzere oluşturulan uluslararası insan hakları hukuku, bu klasik modeli değiştirmiştir.Öte yandan 1970’lerde şirketlerin de aralarında bulunduğu devlet dışı aktörler, küreselleşme olgusununbir sonucu olarak uluslararası hukukun odak noktalarından biri haline gelmiş ve bu kez de insan haklarına ilişkin hukuktabir değişim başlamıştır. BM Rehber İlkeleri, iş dünyası-insan hakları ilişkisini düzenleyen temel metindir ancakbu ilişkinin gerektirdikleri, bazı teorik ve pratik sorunları beraberinde getirmektedir. Şirketlerin insan haklarına ilişkinyükümlülüklerinin niteliği ve temellendirilmesi meselesi, bu makalenin konusunu oluşturmaktadır.

Öz: Sovereign states have been the main subjects of classical international law based on the Westphalian model. But international human rights law formulated for the protection of individuals mainly against arbitrary state intervention has transformed this classical model. On the other hand, in the 1970s non-state actors including corporations have become one of the focal points of the international law as a result of globalism and this time international human rights law has started to changing. UN Guiding Principles is the main instrument determining business-human rights relations, but it brings some theoretical and practical problems about the implications of these relations. The nature of the corporate obligations relating to human rights and the question of its justification is the main question of this article.
