UNUTULMA HAKKININ AVRUPA BİRLİĞİ’NİN GENEL VERİ KORUMA TÜZÜĞÜ ÇERÇEVESİNDE İNCELENMESİ
Öz: Unutulma hakkı, tarihsel perspektif içinde bireyin özel hayatınıngizliliği ve bilhassa bilginin geleceğini belirleme hakları ile birlikteincelenmiş ve yorumlanmıştır. Dijital çağda iletişim olanakları artmış veşirketler açısından da yeni fırsatlar doğmuştur. Bununla birlikte, bu yeniortamda bireylerin kişisel verilerinin korunabilmesi için de yepyeni birçerçevenin kabulünün gerektiği kabul edilmelidir. Avrupa Birliği, GenelVeri Koruma Tüzüğü (GDPR), bu işlevi yerine getirmek üzere kabuledilmiştir. GDPR ile unutulma hakkı ilk kez açık bir şekilde düzenlenmiştir.Yeni düzenlemeler, veri kontrolorü ve veri işleyicisi niteliği taşıyan şirketleraçısından da yeni ve ağır yükümlülükler getirmektedir. Makalede, dahadetaylı olarak, bu yeni yükümlülükler inceleme konusu yapılmıştır.

Öz: The right to be forgotten has been examined and interpreted in the historical perspective with the right of privacy and especially with the informational self-determination. In the digital age, communication opportunities have increased and new opportunities have emerged for companies. However, it should be accepted that a new framework should be adopted in order to protect the personal data of individuals in this new environment. The European Union, General Data Protection Regulation (GDPR) has been accepted to perform this function. With GDPR, the right to be forgotten is clearly arranged for the first time. The new regulations also impose new and severe obligations for companies that are data controllers and data processors. In this Article, these new obligations are examined in more detail.
