LÜKSEMBURG’DA OMBUDSMAN KURUMU
Öz: Kamu yönetimiyle olan ilişkilerinde güçsüz birkonuma sahip olmaları nedeniyle bireyleri kamuyönetimi karşısında korumak üzere zaman içindedestekleyici kurum ve yöntemler geliştirilmiştir.Ancak kamu yönetimi faaliyetlerinin teknik bir halalması geleneksel koruma ve denetim kurumlarınınyetersiz kalmasına yol açmıştır. Ortaya çıkan bu korumaaçığını kapatmak üzere oluşturulan kurumlardanbirisi ombudsmandır. Ombudsman modelininuzlaştırıcı ve arabulucu rolüyle yönetsel şikayetleriçözmede başarı göstermesi bu kuruma karşı olan ilgiyiarttırmıştır. Son dönemde bu ilginin görüldüğüülkelerden birisi Lüksemburg’dur. Lüksemburg’daombudsman kurumunun kurulması ile kişilerinyönetim karşısında korunmasında yeni bir safhayageçilmiştir. Çalışmanın amacı, Lüksemburg’daombudsman kurumunun kamu yönetimi ile yönetilenlerarasındaki ilişkileri nasıl etkilediğini ortayakoymaktır. Çalışmada kanuni metin, ombudsmanınresmi rapor ve tavsiye kararları incelenerek belgeanalizi gerçekleştirilmiştir.

Öz: Supporting institutions and methods have been developed over time to protect individuals against public administration as they have a weak position in their relations with public administration. However, the fact that public administration activities became technical led to the insufficiency of traditional protection and control institutions. One of the institutions established to cover this emerging vulnerability is the ombudsman.The success of the Ombudsman model in resolving administrative complaints with its conciliatory role, has increased the interest towards this institution. One of the countries where this interest has been seen recently is Luxembourg.With the establishment of the ombudsman institution in Luxembourg, a new phase has been started in protecting people against administration.The aim of the study is to reveal how the ombudsman institution in Luxembourg affects the relations between public administration and those administered.In the study, the legal text, the official reports and recommendations of the ombudsman were examined and document analysis was carried out.
