ASURCA VE BABİLCE METİNLERDE YEMİN

Öz:
Bu makalede Asur ve Babil’de yemin uygulamasının sosyal, ekonomik, hukukî ve siyasî hayat içerisindeki yerive önemi ele alınmaktadır. Bu amaçla hem resmi nitelikteki kraliyet yazıtları ve hukukî kayıtlar hem de şahıslaraait hukukî ve ekonomik nitelikteki belgeler incelenmiştir. Asur ve Babil’de yemin uygulanması toplum hayatıiçerisinde sorunların çözümünde ve gerçeğin ortaya konulmasında önemli bir işlevi yerine getirmiş, ayrıcasözleşme ve anlaşmalarda taahhüt edici bir amaca hizmet etmiştir. İncelediğimiz belgeler, yemin etme eyleminindinsel bir nitelik taşıdığını ve eylemin tapınakta, mahkemede ve kutsal mekânlarda, tanrıların huzurundagerçekleştirildiğini göstermektedir. Asur ve Babil’de yalan yere yemin edenlerin ve ettikleri yemini tutmayanlarınağır cezalarla yüzleşmeleri, yeminin bağlayıcı bir özelliği olduğunu ortayakoymaktadır.

Öz:
In this article, the place and importance of the practice of oath in social, economic, legal and political life in Assyria and Babylon is discussed. For this purpose, both royal inscriptions and legal records created by the state and economic documents belonging to private citizens were examined. The practise of the act of oath in Assyria and Babylon fulfilled an important function in solving the problems and revealing the truth in the community life, and also served a committed purpose in contracts and agreements. The documents which we examined show that the act of oath was of a religious characteristic and that the act was carried out in temples, court and holy places in the presence of the gods. In Assyria and Babylon, those who swear a false oath and those who do not take the oath are punished with penalties, which reveals that an oath has a binding feature.
