JEAN BODIN’İN SİYASET FELSEFESİNDEDEVLET VE EGEMENLİK
Öz: Modern devlet teorisinin temel ilkesine göre, devlet, kendi yetki alanıiçinde hukukun en üstün ve tek kaynağıdır. Bu ilkeyi ilk defa, Les Six Livres de la Republique (1576) adlı eserinde Fransız siyaset felsefecisi Jean Bodin ileri sürmüştür. Bu ilke daha önceki çağlarda Roma Hukukunda legibus solutus ya da suprema lex ile ve 13.yüzyıl Kilise hukukçularının Papaya ve imparatora atfettikleri “plenitudo potestatis” niteliği ile ilan edilmiş olsa da, Bodin’in egemenlik teorisi devrim niteliğindedir. Bodin’e siyaset felsefesi alanında devrimci sıfatının verilmesine neden olan temel özellik, ondan önce kimsenin egemenlik ilkesini açık bir şekilde tanımlamamış ve onun ortaya koyduğu bir içerikte savunmamış olmasıdır. Ortaçağ hukuk anlayışına göre, prensin yasa yapma ve değiştirme yetkisi olmasına rağmen, aynı prens mevcut yasalarıkorumak ve onlara uymakla yükümlüydü. Fakat Bodin, teorisi ile egemene genişbir hareket sahası tanımıştır. Buna göre, egemen, istediği zaman yasa yapabilmeli ve değiştirebilmelidir. Bu anlamda Bodin, egemenlik ilkesini mutlak ve sürekli en üstün emretme gücü olarak tanımlamıştır. Bununla birlikte, egemenliğin mutlak olması onun sınırsız olduğu anlamına gelmemektedir. Egemen, ilahi ve doğal yasalara uymakla yükümlüdür. Bodin, kendinden önceki teorisyenlerin ele almadığı egemenlik ilkesini somut olarak tanımlamış ve dünyevi bir meşruiyet zeminine oturtmuştur. Bodin’in egemenlik teorisi siyasal düşünce tarihinde, hukuk düzeninin temelini mevcut yasalardan, yasa yapan prense kaydıran kavramsal bir devrim olmuştur.

Öz: One of the main principles of modern political philosophy is that, state isthe supreme and only source of law within its jurisdiction. This principle wasfirst asserted by the French political philospher Jean Bodin in his credited book,Les Six Livres de la Republique (1576). Altough it was decleared earlier byRoman law as legibus solutus or suprema lex and then in 13th century byCanonists to attribute “plenitudo potetatis” to Pope and to the Emperor,Bodin’s theory of sovereignty deserves to be qualified as revolutionary. The keyfeature of Bodin’s theory is that noone has ever attempted to define the conceptas clear cut as Bodin did and moreover defended it with that content. Accordingto medival legal discourse , the king has power to make law and amend it at hiswill but he was bound by the recent laws. But Bodin enabled the king to makelaw and amend them at his will without any bounds other then divine andnatural law. Hence, Bodin defined sovereignty as “absolute”, “perpetual” andsupreme power to command. Bodin identified and justified the conceptperceptibly which earlier theorists avoided. Bodin’s theory on sovereignty canbe seen as a shift in the history of political thought since the foundations of legalorder was transferred to law making prince from the existing laws and therebymarks a conceptual revolution.
