AVRUPA BİRLİĞİ’NDE ÇEVRİMİÇİ ARACILIK HİZMETLERİNİN DÜZENLENMESİ - UBER VE AIRBNB ÖRNEKLERİ

Öz:

Bilgi teknolojilerinde son dönemde yaşanan hızlı gelişmelerin de etkisi ilebirlikte geleneksel yöntemlerin dışında hizmet sunma modelleri ortaya çıkmaktadır.Paylaşım ekonomisi modeli kapsamında özel kişiler de artık profesyonel hizmetsunucular ile birlikte çevrimiçi platformlar aracılığı ile hizmet sunmaktadır.Platformlar tarafından sunulan ve çevrimiçi aracılık olarak tanımlanacak bu hizmetAB’de iş kurma hakkı/hizmetlerin serbest dolaşımı veya bilgi toplumu hizmetikapsamında sınıflandırılabilir. Bu ayrımın sonucu olarak da çevrimiçi aracılık;hizmetlere ilişkin kurucu antlaşmadaki düzenlemelere, Hizmetler Direktifi’ne, bilgitoplumu hizmetlerine ilişkin Direktiflere veya sektörel, örneğin taşımacılık hizmetleri,düzenlemelere tabi olacaktır. Buna karşın bu sınıflandırmanın nasıl yapılacağına ilişkinaçık bir AB düzenlemesi henüz mevcut değildir. Bu nedenle soru şimdiye kadar ABADiçtihadı ile cevaplandırılmıştır. Bu çalışma ABAD’ın Uber ve Airbnb kararlarındanyola çıkarak çevrimiçi aracılık hizmetlerine hangi AB düzenlemelerinin nasıluygulandığı sorusunun cevaplandırılmasını ve değerlendirilmesini amaçlanmaktadır.Çalışma neticesinde AB’nin çevrimiçi aracılık hizmetlerine ilişkin sınıflandırmave uygulamasının ABAD içtihadı ile geliştiği, taşımacılık sektörü açısından dahasınırlayıcı olduğu, mevcut çevrimiçi aracılık türleri bakımından ikna edici olmadığıve yasal bir düzenlemenin gerekli olduğu sonuçlarına ulaşılmıştır.

Due to the recent rapid developments in information technologies, new service providing models, other than traditional methods, are emerging. Within the scope of the sharing economy model, private individuals now can provide services through online platforms along with professional service providers. In the EU, this service provided by the platforms, which will be defined as online intermediation, can be classified under right of establishment/free movement of services or information society service. Consequently, online intermediary service could be subject to the provisions of the TFEU, Services Directive, the Directives on information society services or sectoral regulations, for example transport services. However, there is no explicit EU regulation on how to make this classification yet. For this reason, the question has answered with the case law of the CJEU so far. This study aims to answer and evaluate the question of which EU regulation shall apply to online intermediary services, based on Uber and Airbnb decisions of the CJEU. It is concluded that the EU’s classification and regulation of online intermediary services has developed with jurisprudence of the CJEU, this jurisprudence found more restrictive in terms of the transport sector, it is not convincing and a legal regulation is required in this field.
