CONSTITUTIONAL CHANGE IN TURKEY: IS A NEW AMENDMENT NECESSARY?

Öz:
Governmental systems that constitute the structure of political systems are one of the most controversial issues of the political agenda. The parliamentary system, which has an unsuccessful history, including Turkey, forced many countries to seek new systems. Excluding the 1921 and 1924 Constitutions, Turkey had a parliamentary government system since the 1876 Constitution. The inability of the parliamentary system to solve some crisis of regime and to overcome political problems caused to come to an agenda of new options such as presidential/semipresidential system. Reinforcement of executive power is being opted as an instrument of transition from parliamentary to presidential system, and a sui generis parliamentary system model was being created by derivations from the classical parliamentary system in the 1982 Constitution. However, as a result of the constitutional amendment referendum held on April 16, 2017, a new turn has been introduced in Turkey's government system and started to effect from June 24, 2018, general elections. This paper aims to discuss, after nearly three years of implementation of new constitutional change in Turkey, whether if a new amendment to the 1982 Constitution is necessary or not. It is expected that the results of comparative research reports of the countries involved in this research will make a significant contribution to future constitutional amendments and also especially in terms of regulations concerning the legislation of the Turkish Grand National Assembly, election laws, and the legislation of political parties.

Öz:
Siyasi sistemlerin yapısını oluşturan hükümet sistemleri, politik gündemin en tartışmalı konularından biridir. Türkiye’deki uygulaması da dahil olmak üzere, başarısız sayılabilecek bir tarihe sahip olan parlamenter sistem, bir çok ülkeyi yeni hükümet sistemi aramaya zorlamıştır. 1921 ve 1924 Anayasaları dışında, Türkiye 1876 Anayasası'ndan bu yana parlamenter hükümet sistemine sahip olmuştur. Parlamenter sistemin bazı rejim krizlerini çözememesi ve siyasi sorunların üstesinden gelememesi nedeniyle, başkanlık/yarı başkanlık sistemi gibi yeni seçenekler gündeme gelmiştir. Yürütme gücünün güçlendirilmesi neticesinde 1982 Anayasası'nda klasik parlamenter sistemden türetilen sui generis bir parlamenter sistem modeli oluşturulmuştur. Ancak, 16 Nisan 2017 tarihinde yapılan anayasa değişikliği referandumu neticesinde, Türkiye'nin hükümet sisteminde yeni bir dönem başlamış ve 24 Haziran 2018 genel seçimlerinden itibaren yine kendine özgü Cumhurbaşkanlığı hükümet sistemi yürürlüğe girmiştir. Bu çalışma, 2017 anayasa değişikliğinin üç yıla yaklaşan uygulamasının ardından, Anayasada yeni bir değişiklik yapılması gerekip gerekmediğini tartışmayı amaçlamaktadır. Araştırmada yer alan ülkelerin karşılaştırmalı sonuç raporlarının gelecekteki anayasa değişikliklerine ve özellikle Türkiye Büyük Millet Meclisi içtüzüğü, seçim yasaları ve siyasi parti mevzuatı ile ilgili düzenlemelere önemli bir katkı yapması beklenmektedir.
