Anayasanın iktisadi temelleri

Öz:
Çalışmanın amacı, bir kurallar ve kurumlar bütünü olarak Anayasaların iktisadi temellerini saptayarak, Hükümet tarafından Profesör Ergun Özbudun başkanlığında altı akademisyene hazırlatılan "Yeni Türkiye Anayasa ÖnerisV'nin bazı maddelerini eleştiriye tabi tutmaktır. Bu bağlamda, başlıca Hukuk ve Ekonomi Okullarının temel önermelerini ele aldıktan sonra, özellikle üç kavram açıklanacaktır: sosyal sözleşme olarak anayasa, eşgüdüm mekanizması olarak anayasa ve anayasanın uygulanabilirliği (zorlanabilirliği). Ayrıca, anayasada bulunması gereken anayasal haklar tartışılacaktır.

Öz:
The purpose of the paper is to determine the economic foundations of constitution as a whole of rules and institutions and to evaluate some articles of "The New Constitution Proposal for Turkey" which was prepared by the Turkish Government to six academics those are led by Professor Ergun Özbudun. In this context, after the fundamental propositions of the main schools of Law and Economics are mentioned, especially three concepts will be explained: constitution as a social contract, constitution as a coordination mechanism and the applicability (or the enforcement) of constitution. In addition, the constitutional rights which must be in constitution will be discussed.
