Savaşın Değişen Niteliği ve Jus ad bellum ve Jus in bello’ya Etkisi

Öz:
Bu çalışma, savaşın niteliği ve uygulanma biçimi ile devletlerarası kuvvet kullanımını düzenleyen Uluslararası Hukuk arasında yakın bir ilişki olduğu varsayımdan hareketle, kuvvete başvurma kurallarını kapsayan jus ad bellum'un ve kuvvet kullanımının fiilen icra edilirken uygulanan kuralları kapsayan jus in bello'nun günümüz savaşın değişen niteliğinden nasıl etkilendiğinin bir incelemesini ortaya koymaya çalışmaktadır. Makale, uluslararası hukukta mevcut bulunan kuvvet kullanmaya ilişkin düzenlemelerinin savaşın siyasi teorisinde ortaya konulan siyasal şiddetin niteliğini esas aldığını ve bu nedenle 'yeni savaşlar' kavramı çerçevesinde dile getirilen günümüz silahlı çatışmaların özelliklerinin mevcut jus ad bellum ve jus in bello'nun kapsamı dışında kaldığını göstermeye çalışmaktadır

The Changing Character of War and its Impact on the Jus ad bellum and the Jus in bello

Öz:
This article is based on the assumption that there is a close relationship between the nature of war and International Law governing the use of force. This study attempts to elucidate how jus ad bellum, which encompasses the rules of the use of force, and jus in bello, which deals with the rules in war, are affected by the changing character of war today. The article argues that the existing regulation regarding the use of force in international law is based on the nature of the political violence as defined in the political theory of war, and that the features of contemporary armed conflicts expressed within the framework of the concept of ‘new wars’ remain outside the scope of the existing jus ad bellum and jus in bello
