GEMİ ADAMI İLE DONATILMAMIŞ (İNSANSIZ) GEMİLERİN DENİZ HUKUKU BOYUTUYLA DEĞERLENDİRİLMESİ

Öz:
İnsansız teknoloji konusundaki gelişmeler tüm sektörleri etkilediği gibidenizcilik sektörünü de etkisi altına almaya başlamıştır. Denizcilik sektörünün engelişmiş teknolojisi insansız gemilerle ilgili özel bir hukuki düzenleme halihazırdamevcut değildir. Bu durum, uluslararası yeknesaklığın en ileri düzeyde olduğu denizhukuku bakımından bir dizi sorunu gündeme getirmektedir. Başta insansız gemilerinhukuken gemi olarak nitelendirilip nitelendirilemeyeceği olmak üzere, mevcut hukukidüzenlemelerin kapsamına insansız gemilerin dahil edilip edilemeyeceği, hukukialtyapının insansız gemiler için yeterli olup olmadığı akla gelen sorular arasındadır.Çalışmada insansız gemilerin hukuki statüsü, tabiiyeti, seyrüsefer hakkı ve gemiadamlarıyla ilgili sorunlar tartışılacaktır

Öz:
Recent developments in unmanned technology have already affected all sectors including the maritime sector. Currently, these ships, the cutting-edge technology of maritime sector, have not been specifically addressed by any international rule or regulation so far. This raises several problems in terms of the international law of the sea and maritime law, where international uniformity is at the highest level. Among the problems that come to mind are whether unmanned ships can be legally qualified as ships, whether unmanned ships can be within the scope of current legal regulations, whether the legal infrastructure is sufficient for unmanned ships. The study will discuss issues related to the legal status, nationality, and navigation rights of unmanned ships and seafarers.
